Cơ quan nhà nước càng không có quyền bằng lệnh hành chính và dùng cảnh sát, quân đội để "giải tỏa mặt bằng", "cưỡng chế thi hành" để thu lấy đất của dân. Khi có tranh chấp giữa dân và nhà nước về quyền tài sản đất đai, chỉ có Tòa án và lực lượng thi hành án mới có sự chính danh để cưỡng chế thi hành các lệnh tòa theo những trình tự tố tụng đảm bảo công lý. Tóm lại, ngôn ngữ làm luật thời nay cũng nên mềm dẻo, tôn trọng dân quyền, bớt đi bạo lực.
